Overview

This website is operated by Elsewhere. Throughout these Terms, “we”, “us” and “our” refer to Elsewhere.

These Terms of Service govern your use of our website and any purchases made from Elsewhere. By using this website or placing an order, you agree to these Terms together with our Privacy Policy, Shipping Policy and Return and Refund Policy.

Nothing in these Terms affects your statutory consumer rights.

1. Our products

Elsewhere creates handcrafted leather journals, wallets, charms and related goods.

We take reasonable care to describe and photograph our products accurately. However, leather is a natural material and may display variations in grain, texture, markings and colour. Colours may also appear slightly different depending on your screen settings.

These natural variations are part of the material and are not normally considered faults.

Product details, availability and prices may be changed or products discontinued without prior notice. Changes will not affect orders we have already accepted.

2. Orders

Placing an order constitutes an offer to purchase from Elsewhere. A contract is formed when we send confirmation that your order has been accepted.

We may decline or cancel an order where reasonably necessary, including where:

  • Payment cannot be authorised.
  • A product or material is unavailable.
  • Pricing or product information contains an obvious error.
  • We reasonably suspect fraudulent or unauthorised activity.
  • We cannot deliver to the address provided.

If we cancel an order after payment has been taken, we will issue a refund to the original payment method.

Please review all order details carefully before submitting your order.

3. Customisation and personalisation

Customers are responsible for checking all selected colours, components, sizes and personalisation details before placing an order.

Personalisation will be created using the text entered at checkout. We are not responsible for customer spelling mistakes or incorrect selections submitted with an order.

Custom-made products, including journals created through our custom journal builder, and products personalised with names or other requested details are made specifically for the customer. These products cannot be cancelled or returned due to a change of mind.

This does not affect your rights if an item is faulty, damaged or different from what you ordered.

4. Prices and payment

Prices are displayed in pounds sterling unless stated otherwise.

The price charged will be the price shown when the order is placed. Delivery charges are displayed separately at checkout.

International customers may be responsible for customs duties, taxes or import charges imposed by the destination country.

Payment must be authorised before an order can be accepted and production begins.

Promotional offers and discount codes may have separate conditions. Unless stated otherwise, discounts cannot be combined.

5. Production

Our products are handcrafted in small batches. Made-to-order pieces normally require 5–10 working days to produce before dispatch.

Production estimates are not guaranteed. If an unexpected delay materially affects an order, we will contact the customer using the information supplied at checkout.

6. Shipping and delivery

Shipping services, estimated delivery times, tracking and international-delivery information are explained in our Shipping Policy.

Customers must provide a complete and accurate delivery address. Contact us as soon as possible if an address needs correcting.

Delivery estimates are not guaranteed, but we remain responsible for the order until it is delivered to the customer or another person identified by the customer.

7. Returns, cancellations and refunds

Return eligibility and instructions are explained in our Return and Refund Policy.

Eligible non-custom items may be returned in accordance with that policy. Custom-made and personalised products are excluded from change-of-mind returns.

Nothing in these Terms limits your legal rights concerning faulty, damaged, misdescribed or incorrect goods.

8. Intellectual property

The Elsewhere name, branding, logos, bird artwork, illustrations, photographs, videos, written content, custom-journal-builder assets and original product designs belong to Elsewhere or are used with permission.

This content is protected by applicable copyright, design-right, trademark and other intellectual-property laws.

You may view the website and share links for personal, non-commercial purposes. You must not copy, reproduce, modify, distribute, sell, manufacture from, publish or commercially exploit our protected content or original designs without prior written permission.

Nothing in these Terms grants ownership of or a licence to Elsewhere’s intellectual property except the limited permission to use the website for personal shopping purposes.

9. Acceptable use

You must not:

  • Use the website for unlawful or fraudulent activity.
  • Attempt to interfere with the website’s security or operation.
  • Introduce viruses, malicious code or other harmful material.
  • Scrape, extract or systematically copy website content.
  • Impersonate another person.
  • Infringe the rights of Elsewhere or another person.

We may restrict access where we reasonably believe the website is being misused.

10. Third-party services and Shopify

Our store is hosted by Shopify, which provides the ecommerce platform used to offer our products.

Purchases are made directly from Elsewhere, not Shopify. Third-party services, payment providers or links may be governed by their own terms and privacy policies.

We are not responsible for third-party websites that we do not control.

11. Privacy

Personal information is handled in accordance with our Privacy Policy.

Information required to process orders may be shared with Shopify, payment providers, delivery companies and other service providers where necessary to operate the store and fulfil orders.

12. Liability

We do not exclude or limit liability where doing so would be unlawful, including liability relating to:

  • Death or personal injury caused by negligence.
  • Fraud or fraudulent misrepresentation.
  • Faulty or misdescribed goods.
  • Any statutory consumer right that cannot legally be excluded.

We are not responsible for losses that were not reasonably foreseeable when the contract was formed or for business losses arising from a purchase made wholly for personal use.

13. Changes to these Terms

We may update these Terms when our services, business practices or legal obligations change.

The Terms applying to an order will be those in effect when that order was placed. Material changes will not retrospectively alter an existing order.

14. Governing law

These Terms are governed by the laws of England and Wales.

If you live elsewhere in the United Kingdom, you retain any mandatory consumer protections and rights to bring proceedings available where you live.
